The Trump administration has requested that the previous approval of the construction and operation plan (COP) for the Revolution Wind project, executed by Ørsted, be returned to the Department of the Interior for further review. This project, located 15 miles off the coast of Rhode Island, is currently in its final construction stages and is expected to be fully operational by the end of this year.

Repeated Challenges from the Trump Administration

This request marks the third time the Trump administration has challenged the Revolution Wind project. In August 2025, the government sought to halt construction while the project was about 80 percent complete, but this request was denied by the court. Additionally, in December 2025, the government ordered a halt to the Revolution Wind's operations, claiming that the project's activities could pose a threat to national security.

However, the courts also rejected this stop-work order and allowed the project to continue construction from January 2026. The new request from the government was filed on October 9, and in this matter, an environmental group named Green Ocean has been pursuing the project in the courts. This group claims that the Revolution Wind project could cause serious environmental harm.

Legal and Environmental Implications

The government's new request to the court includes a request for a summary judgment in favor of Green Ocean against the National Marine Fisheries Service and the U.S. Army Corps of Engineers. This request also reflects the Department of the Interior's agreement to review the previous approval of the Revolution Wind construction and operation plan to ensure that the project complies with the Outer Continental Shelf Lands Act.

The Revolution Wind project, with an investment of $6.2 billion, is jointly financed by Ørsted and its investment partner, Skyborn Renewables. While the Trump administration has repeatedly attempted to challenge offshore wind energy projects, this new action comes after a bipartisan agreement in the U.S. Senate to reform the permitting process for major infrastructure projects.

Despite the legal challenges the government faces, this move may jeopardize the bipartisan agreement to reform the infrastructure project approval process. New reports also indicate that the Pentagon has recently released documents showing that it is resuming its previously suspended reviews.
