On November 4, 2023, the European Court of Justice issued a ruling that confirms most of the restrictive measures of the European Council against the Russian Maritime Registry. The court concluded that the European Council acted within its legal powers in imposing sanctions against this organization as part of the Russian government and pressuring the country to stop the war in Ukraine.

Background of the Sanctions

The main challenge by the Russian Maritime Registry aimed to contest the restrictions imposed since 2014, which intensified after the invasion of Ukraine in 2022. The primary issue was the examination of the European Council's powers to impose transaction restrictions and prohibitions on this organization and the ships registered under it. Additionally, the revocation of the recognition of this organization as a classified entity responsible for inspection and certification for maritime transport was also a focal point.

The Russian Maritime Registry had been recognized by the European Union since 1998 and was authorized to conduct inspections, surveys, and certification activities for ships under the Russian flag or the flags of other countries. The first sanctions were imposed in 2014, following the occupation and annexation of Crimea by Russia, and these restrictions were intensified after the invasion of Ukraine in February 2022 and have expanded over the past four years.

Confirmation and Revocation of Restrictions

The European Council has imposed financial restrictions on doing business with the Russian Maritime Registry, including a ban on investments. Additionally, transactions with this organization and access for ships certified by this entity to EU ports and locks have also been prohibited. The Court of Justice confirmed all prohibitions in its ruling but deemed the action to revoke the recognition of this organization as disproportionate.

The court stated that the European Commission could have achieved the same effect by suspending the recognition of the organization. This means that revocation of recognition does not automatically allow for a return to the previous state if the restrictions are lifted, and this organization must undergo a new recognition process, the outcome of which is uncertain.

However, the court rejected most of the actions against the Russian Maritime Registry and stated that the European Council fulfilled its duty in providing reasons for the actions taken and presented real and specific reasons for extending the investment ban in the maritime sector. Furthermore, these actions align with the interests of the European Council's foreign policy and common security.

The challenge to the restriction on access for registered ships to EU ports was also deemed unacceptable by the court. The court stated that these actions only indirectly affect the legal status of the organization, as their target is the ships and maritime companies.

Economic Consequences

This decision is considered a significant ruling as it confirms the European Council's authority to implement restrictive measures when there are clear and justified reasons. By mid-2026, the European Union has sanctioned over 670 ships, primarily related to Russia's "shadow" fleet, and imposed further restrictions on other sectors that directly support maritime operations.

The European Union claims that these sanctions have a meaningful impact on Russia and its economy and are a key component of efforts to end the war in Ukraine.
